PLEASE READ THESE TERMS CAREFULLY. THESE TERMS CONTAIN AN ARBITRATION AGREEMENT, A CLASS ACTION WAIVER, AND A JURY WAIVER THAT AFFECT YOUR LEGAL RIGHTS. BY ACCESSING OR USING THE SERVICE, YOU ACCEPT AND AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT, CLASS ACTION WAIVER, AND JURY WAIVER.

WonkTax provides users with a tax estimation tool for federal and state income taxes based on W-2 earnings. The Service is provided free of charge, with an optional donation feature to support ongoing development and maintenance.

The Service is designed exclusively for W-2 income taxpayers filing as single or married filing jointly. For complex filings including investments, capital gains, or business income, please consult with a tax professional.

You acknowledge that WonkTax is operated by an individual without the legal protection of a corporation or limited liability company. By using the Service, you agree to hold harmless the individual operator of WonkTax from any and all claims to the fullest extent permitted by law.

3. No Professional Tax Advice

WonkTax is provided for informational and estimation purposes only. The information provided by the Service:

• Is not intended to be a substitute for professional tax, financial, or legal advice.
• May not be fully accurate due to limitations in our data, changes in tax laws, or other factors.
• Should not be relied upon for the purpose of avoiding penalties under tax law.

4. Free Service & Donations

WonkTax is provided to users free of charge. We do not require payment for access to our tax calculation tools.

We offer the option to make voluntary donations to support the ongoing development, maintenance, and improvement of WonkTax. These donations:

• Are entirely voluntary and not required to access any features of the Service.
• Do not entitle donors to additional features, priority support, or any special treatment.
• Are not tax-deductible as charitable contributions.
• Are non-refundable once processed.
• Are made directly to the individual operator of WonkTax and not to any business entity.
• Do not create any contractual relationship, partnership, agency, or fiduciary relationship beyond these Terms.

By making a donation, you acknowledge that you are doing so voluntarily and that no goods or services will be provided in exchange for your donation beyond the free Service already available to all users.

For cryptocurrency donations, you acknowledge the inherent risks of cryptocurrency transactions, including but not limited to transaction errors, price volatility, and security risks. Once sent, cryptocurrency donations cannot be refunded due to the nature of blockchain technology.

5. User Responsibilities

As a user of WonkTax, you agree to:

• Provide accurate and complete information when using the Service.
• Use the Service only for lawful purposes and in accordance with these Terms.
• Not attempt to manipulate, reverse engineer, or exploit the Service.
• Independently verify any calculations or estimates before relying on them for tax filing or financial decisions.

You are solely responsible for verifying the accuracy of any calculations provided by WonkTax before using them for any official purpose.

6. Privacy and Data Security

WonkTax does not store any personal information or tax data you enter into the calculator. All calculations are performed client-side in your browser, and no personal or financial data is transmitted to or stored on our servers.

While we take reasonable steps to ensure the security of our website, no internet transmission is ever completely secure. By using the Service, you acknowledge and accept this inherent risk.

You understand and agree that:

• The Service does not collect your tax information or store any personally identifiable information.
• Any information you enter remains within your browser session only.
• Standard web hosting logs (such as IP addresses, browser types, access times) may be automatically collected for security and operational purposes.

TO THE FULLEST EXTENT PERMITTED BY LAW, WONKTAX, ITS OPERATOR (AS AN INDIVIDUAL), AGENTS, REPRESENTATIVES, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WONKTAX DOES NOT WARRANT THAT:

• THE SERVICE WILL MEET YOUR REQUIREMENTS;
• THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
• THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPLETE;
• THE CALCULATIONS PROVIDED WILL BE FREE FROM MATHEMATICAL OR LOGICAL ERRORS;
• THE TAX RATES AND RULES IMPLEMENTED WILL REFLECT CURRENT LAW OR YOUR PARTICULAR TAX SITUATION;
• ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WONKTAX AND ITS INDIVIDUAL OPERATOR, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SYSTEM FAILURE, ADDITIONAL TAX LIABILITY, PENALTIES OR INTEREST IMPOSED BY TAX AUTHORITIES, OR DAMAGES RESULTING FROM:

• YOUR USE OF OR INABILITY TO USE THE SERVICE;
• ANY ERRORS, OMISSIONS, OR INACCURACIES IN THE INFORMATION OR CALCULATIONS PROVIDED;
• RELIANCE ON ANY INFORMATION OR CALCULATION PROVIDED BY THE SERVICE;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
• ANY CONTENT OBTAINED FROM THE SERVICE; AND
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

IN NO EVENT SHALL THE TOTAL LIABILITY OF WONKTAX OR ITS INDIVIDUAL OPERATOR TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE LESSER OF (1) ANY AMOUNTS PAID BY YOU TO WONKTAX DURING THE PRIOR TWELVE (12) MONTHS, IF ANY, OR (2) ONE HUNDRED DOLLARS ($100).

YOU SPECIFICALLY ACKNOWLEDGE THAT THE INDIVIDUAL OPERATOR OF WONKTAX SHALL NOT BE LIABLE FOR ANY USER CONTENT OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

8. Indemnification

You agree to defend, indemnify, and hold harmless WonkTax, its individual operator (in both their personal and professional capacities), representatives, agents, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

• Your use of and access to the Service;
• Your violation of any term of these Terms;
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right;
• Any claim that your use of the Service resulted in tax errors, additional tax liabilities, penalties, or interest;
• Any claim that the Service constituted professional tax advice or tax preparation services as defined under applicable law;
• Any claim by a third party arising from or related to your use of the Service.

This defense and indemnification obligation will survive these Terms and your use of the Service. You acknowledge that the individual operating WonkTax is doing so in a personal capacity without corporate protection, and this indemnification extends to protect them individually to the fullest extent permitted by law.

9. Intellectual Property

All content, features, and functionality of the Service, including but not limited to design, text, graphics, logos, icons, images, code, and software, are the exclusive property of WonkTax or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Service, except as follows:

• You may use the Service for personal, non-commercial purposes only.
• You may print or download content for personal reference only.

10. Governing Law, Jurisdiction, and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction selected by the operator of WonkTax at the time a dispute arises, without regard to its conflict of law provisions.

ANY DISPUTE, CLAIM OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION OR VALIDITY THEREOF, INCLUDING THE DETERMINATION OF THE SCOPE OR APPLICABILITY OF THIS AGREEMENT TO ARBITRATE, SHALL BE DETERMINED BY BINDING ARBITRATION AT A LOCATION SELECTED BY THE OPERATOR OF WONKTAX AT THE TIME A DISPUTE ARISES. THE ARBITRATION SHALL BE HELD BEFORE A SINGLE ARBITRATOR AND ADMINISTERED BY JAMS OR A COMPARABLE ARBITRATION SERVICE SELECTED BY THE OPERATOR OF WONKTAX, PURSUANT TO ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES. JUDGMENT ON THE AWARD MAY BE ENTERED IN ANY COURT HAVING JURISDICTION.

NOTWITHSTANDING THE FOREGOING, YOU ACKNOWLEDGE THAT UNAUTHORIZED USE OF THE SERVICE WOULD CAUSE IRREPARABLE HARM AND THAT, IN SUCH CASE, THE INDIVIDUAL OPERATOR OF WONKTAX SHALL BE ENTITLED TO SEEK INJUNCTIVE OR OTHER EQUITABLE RELIEF IN STATE OR FEDERAL COURT WITHOUT THE REQUIREMENT TO POST A BOND.

THIS PROVISION SHALL NOT PRECLUDE PARTIES FROM SEEKING PROVISIONAL REMEDIES IN AID OF ARBITRATION FROM A COURT OF APPROPRIATE JURISDICTION.

YOU AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST WONKTAX OR ITS INDIVIDUAL OPERATOR ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

11. Termination and Service Availability

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

You acknowledge that WonkTax is operated by an individual as a personal project and not as a commercial enterprise. As such:

• The Service may be discontinued at any time without notice.
• There is no guarantee of continuous, uninterrupted, or secure access to the Service.
• Updates, maintenance, and improvements are provided at the sole discretion of the operator.
• The operator makes no commitments regarding the continued availability of the Service for any specific period.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
